1. Agreement to Terms
By accessing or using FixNow's services, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service.
2. Description of Service
FixNow is a platform that connects homeowners with independent service professionals ("Pros") for home repair and maintenance services. FixNow does not itself provide home services; it acts as a marketplace facilitating connections between users and Pros.
Pros are independent contractors, not employees of FixNow. FixNow does not control the manner or method by which Pros perform their services.
3. User Accounts
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Maintain the security of your password and account
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
4. Booking and Payments
When you book a service through FixNow:
- You authorize us to place a hold on your payment method
- Final charges are processed after service completion
- Prices shown are estimates; final pricing may vary based on actual work performed
- You agree to pay all charges at the prices then in effect
5. Cancellation Policy
You may cancel a booking free of charge up to 2 hours before the scheduled appointment time. Cancellations made within 2 hours of the appointment may be subject to a cancellation fee. No-shows will be charged the full service fee.
6. User Conduct
You agree not to:
- Use the Service for any illegal purpose
- Harass, abuse, or harm another person
- Provide false or misleading information
- Interfere with or disrupt the Service
- Circumvent the platform to avoid fees
- Post fraudulent reviews or ratings
7. Limitation of Liability
FixNow acts only as a platform connecting users with Pros. We are not responsible for the quality, safety, or legality of services provided by Pros. To the maximum extent permitted by law, FixNow shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
8. Dispute Resolution
Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
9. SMS / Text Messaging Terms
By providing your mobile phone number and checking the SMS consent box at sign-up (or by enabling SMS notifications in your account settings), you expressly consent to receive text messages from FixNow at the number provided, including messages sent by automatic telephone dialing system. Consent to receive SMS is not a condition of any purchase or use of the Service.
- Program description: FixNow sends account-verification codes, new job-lead notifications (for service professionals), booking confirmations and updates, provider arrival alerts, completion and cancellation notices, password resets, and other transactional and account-related messages.
- Message frequency: Recurring. Frequency varies based on your activity (typically 1–10 messages per week for active users).
- Message and data rates: Message and data rates may apply per your wireless carrier agreement. FixNow does not charge you for SMS messages.
- Opt out: Reply STOP to any FixNow SMS at any time to unsubscribe. You will receive a one-time confirmation; no further SMS will be sent thereafter (except as required to confirm your opt-out).
- Help: Reply HELP to any FixNow SMS for help, or email customer@fixnow.inc.
- Supported carriers: FixNow SMS is supported on all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, Sprint, US Cellular, and others. Carriers are not liable for delayed or undelivered messages.
- Privacy: Your mobile number and SMS consent information are handled in accordance with our Privacy Policy. We do not sell, rent, or share mobile information with third parties for marketing purposes.
10. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the Service. Continued use of the Service after such modifications constitutes acceptance of the updated terms.
